Its ridiculous that we have to have a law that says a doctor should not be asking and tracking whether there is a gun in the home.

Not surprisingly, the American Academy of Pediatrics (AAP) has come out against this landmark legislation, based on a concern that it could block pediatricians from their key role in protecting children. I think this is a fair point when you consider that children are frequently injured playing with guns when a parent isn’t right there in the room.

== two problems here. KEY ROLE in protecting children. Its funny how we can't harm prostitutes by communicating with police because they wont come in for treatment, but we can harm children because some parents wont bring their children in because pediatricians are apparently have a key role in protecting children (from their parents).

== second, children are frequently injured playing with guns? I would hardly call the incident of accidents involving guns and children to be "frequent". It happens, but the incidence of children being harmed in car accdients is FAR fuking more frequent than with guns. Do we need to start asking if they have a car in the house? SUV or sedan? Trampolines too. My kid just broke both bones in his wrist on a trampoline. They need to know if we have a trampoline because a kid might get hurt. FFS

Asking should be a right of free speech, imo.

Certainly, the parent should be able to decline to answer, but still have their child treated.

I agree in principle that an individual doctor can decide to ask if he wants.

however, if the doctor is being required to ask by a government mandated program (like medicare) or by state reporting rules and general coercion... and is in fact not asking as a private citizen, but as an agent of the state...

then I don't think we're talking about free speech anymore.
